YES WE CAN!



International Day against Homophobia (IDAHO) campaigners around the world are celebrating the historic statement in support of LGBT Rights which was presented to the General Council of the United Nations yesterday. The statement was signed by 66 countries. Campaigners described this development has a historic first step, while noting that the US refused to sign the statement and the Vatican and Organisation of the Islamic Conference had campaigned vigorously against it.



Louis George Tin, the founder of IDAHO said in New York last night “IDAHO has worked hard for two years to promote this issue. For us this is a great achievement”. Derek Lennard, IDAHO UK Coordinator thanked those in the UK who had arranged IDAHO events and had supported the campaign. He added “This demonstrates that activism can work and that apathy and cynicism have no place in the continuing fight for worldwide rights of gay, lesbian and trans people”.



In the UK parliament an Early Day Motion*, tabled by Liberal Democrat MP Evan Harris to coincide with the UN statement has already been signed by MP’s from five political parties, and campaigners are being urged to ask their MPs to add their signatures.

*That this House notes the historical declaration against discrimination based on sexual orientation and gender identity, presented to the General Assembly of the United Nations in December 2008; further notes that this declaration was submitted by the French government in consultation with the International Day against Homophobia (IDAHO); and urges the British Government to continue to work with other governments and non-governmental organisations to ensure that there is enough support in the UN for a resolution to be passed to decriminalise homosexuality and to end gender identity discrimination around the world.

THE PROTECTION OF LEGAL RIGTHS AND FREEDOM IS FOUND IN THE ANDORRAN CONSITUTION OF 1993, WHICH GUARANTEES HUMAN RIGHTS AS A BASE FOR POLITICAL ORDER, PEACE AND JUSTICE.

La protecció, a Andorra, dels drets i les llibertats es troba a la pròpia Constitució del 1.993, que garanteix els drets de la persona com a fonament de l'ordre polític, la pau i la justícia.

IN DETAIL, THE ARTICLE 6 REFLECTS THE BASES OF NO DISCRIMINATION FOR MOTIVES OF RACE, SEX, ORIGEN, RELIGION, OPINION OR WHATEVER PERSONAL OR SOCIAL CONDITION.
AND MORE, THE "CARTA MAGNA" OBLIGES THE PUBLIC MANDATORIES TO CREATE THE CONDITIONS NECESARY, TO SECURE THAT THE EQUALITY OF INDIVIDUALS IS REAL AND EFECTIVE.

Concretament, l'article 6 recull el principi de la no discriminació per motius de raça, sexe, origen, religió, opinió o qualsevol altra condició personal o social. A més, la Carta Magna exigeix als poders públics la creació de les condicions necessàries perquè la igualtat dels individus sigui real i efectiva.

WE SHOULD REMARK THAT THE ANDORRAN CONSTITUTION PROPOSES AND DEFENDS THE UNIVERSAL DECLARATION OF HUMAN RIGHTS. THIS IS TO SAY, THAT THE BASES IN THE 2ND ARTICLE OF THE DECLARATION ARE DIRECTLY APLYABLE TO THE PRINCIPALITY OF ANDORRA.

Cal destacar que la Constitució andorrana propugna la vigència de la Declaració universal dels drets humans. És a dir, els principis recollits a l'article 2 de la declaració són directament aplicables al Principat.

CONCERNING FAMILIES, ANDORRA RECOGNIZES THE UNIONS OF COUPLES WITH CIVIL EFFECTS BETWEEN SAME SEX COUPLES, SINCE 2005. THIS MEANS, USING AN EXAMPLE, THE ONE PART OF A COUPLE NOT REGISTERED BY OUR SOCIAL SECURITY SYSTEM, STILL ENJOYS THE SAME BENEFITS AS HIS/HER PARTNER, WHO IS.

UNITED COUPLES BENEFIT THE SAME SUCCESORS RÉGIME AS MARRIED COUPLES AND CAN OPT TO REGROUP FAMILY MEMBERS, IN THE CASE OF BEING IMMIGRANTS. OTHER RIGHTS AND OBLIGATIONS ARE ALSO EQUAL TO THOSE OF MARRIED COUPLES.

En l'àmbit familiar, Andorra reconeix les unions de fet amb efectes civils entre parelles del mateix sexe des del 2.005. D'aquesta manera, i a títol d'exemple, el membre de la parella que no està inscrit al sistema de seguretat social, gaudeix dels beneficis del membre que hi està. Les parelles de fet gaudeixen del mateix règim successori que els matrimonis, i poden optar al reagrupament familiar entre membres, en cas que siguin immigrants. L'obligació d'aliments, l'ordre de preferència en la del·lació, i altres drets i obligacions també s'equiparen als dels matrimonis.

3) SOCIAL ACCEPTANCE:aceptació social

IN ANDORRA IT IS NOT NECESARY TO TALK ABOUT SOCIAL ACCEPTANCE BECAUSE THE FACT OF HOMOSEXUALITY IS A NATURAL PART OF LIFE. ONE DOES NOT SPEAK ABOUT GAYS AAND LESBIANS AS IF THEY WHERE SEPARATE GROUPS. BEING GAY OR LESBIAN IN ANDORRA MEANS LIVING A SEXUAL OPTION THE NORMAL WAY. NOT ONLY BETWEEN FRIENDS AND IN THE FAMILY CIRCLE, BUT ALSO WITH THE REST OF THE ANDORRAN SOCIETY.

A Andorra no cal parlar d'acceptació social perquè el fet homosexual es viu naturalment, sense que es parli de gais i lesbianes com a col·lectius estranys. Ser gai o lesbiana a Andorra significa viure una opció sexual amb total normalitat, no només en l'àmbit familiar o d'amistats, sinó també amb la resta de la societat.
